These Terms and Conditions (“Terms”) govern the sale of photographic prints and related products (“Products”) by Illusive Works (“we,” “our,” “us”) through our website www.illusiveworks.com (“Site”). By placing an order, you agree to be bound by these Terms. If you do not agree, please do not purchase from our Site.
2. Intellectual Property Rights
- All photographs, images, and designs are the sole property of Charl Kroeger/Illusive Works and are protected by copyright and intellectual property laws.
- Purchasing a print does not transfer copyright or reproduction rights.
- You may not reproduce, scan, distribute, or resell any purchased print without our written permission.
3. Product Information & Representation
- We strive to display our Products as accurately as possible. However, colors may vary slightly due to monitor settings and printing processes.
- Sizes listed are approximate; slight variations may occur.
- Limited editions are produced in restricted quantities and will not be reprinted once sold out.
4. Pricing & Payment
- All prices are listed in US$ and are subject to change without notice.
- Payment must be made in full before orders are processed.
- We accept Credit card, PayPal, Venmo.
- Any applicable taxes or duties are the buyer’s responsibility.
5. Shipping & Delivery
- We ship to United States and US territories.
- Shipping costs and delivery times are provided at checkout and vary by location.
- We are not responsible for delays due to customs, postal services, or circumstances beyond our control.
- Risk of loss passes to the buyer upon delivery to the carrier.
6. Returns, Exchanges & Refunds
- Due to the custom nature of our prints, all sales are final unless the Product arrives damaged or defective.
- If your order is damaged in transit, please contact us within 5 days of delivery with photographic evidence, and we will arrange a replacement or refund.
- Refunds will be issued to the original payment method.
7. Limited Liability
- We are not liable for any indirect, incidental, or consequential damages arising from your use or purchase of our Products.
- Our total liability for any claim will not exceed the purchase price paid for the Product in question.
8. Governing Law
- These Terms shall be governed by and construed in accordance with the laws of California.
- Any disputes will be resolved exclusively in the courts of California.
